Terms of Service

1. Description of Service

Profica is an AI-powered career document generation platform. You create a professional career profile and use it to generate tailored application materials — including resumes, cover letters, pitch statements, and platform-specific profiles (e.g. LinkedIn, Upwork) — using artificial intelligence. The Service also provides generation history, parameter controls, and export functionality.

2. Account Responsibilities

You must provide accurate and truthful information when creating an account. Each individual may maintain only one account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@profica.ai if you suspect unauthorized access.

You must be at least 16 years of age to use the Service. By registering, you represent that you meet this requirement.

3. Credits and Payments

The Service operates on a credit-based system. Credits are consumed when you generate content (e.g. 3 credits for a full application pack, 1 credit for a platform profile or refinement).

• Purchased credits do not expire and remain in your account until used.
• Free and promotional credits (e.g. credits earned from profile completion) expire 90 days after grant unless otherwise stated.
• Subscription credits roll over for one billing cycle. Unused subscription credits expire at the end of the second billing cycle.

All purchases are processed through Lemon Squeezy and are subject to Lemon Squeezy's terms of service. Lemon Squeezy acts as the Merchant of Record for all transactions.

Refunds: Credits are non-refundable for cash. If a generation fails due to a technical error on our end, your credits will not be deducted. Refund requests for purchases must be submitted within 14 days and are processed by Lemon Squeezy in accordance with their refund policy and applicable consumer protection laws.

4. AI-Generated Content

Content generated by the Service is produced by artificial intelligence based on information you provide. You acknowledge and agree that:

• Generated content constitutes AI-generated suggestions, not professional career advice.
• You are solely responsible for reviewing, verifying, and editing all generated content before submitting it to employers or publishing it on any platform.
• The Service does not guarantee employment, interviews, or any specific career outcome.
• AI outputs may occasionally contain inaccuracies, inconsistencies, or content that does not fully reflect your experience. Always verify before use.

5. Intellectual Property

Your content: You retain full ownership of all data you provide (profile information, job descriptions) and all content generated by the Service on your behalf (resumes, cover letters, pitch statements, platform profiles). We claim no ownership over your inputs or outputs.

Our content: The Service itself — including its design, branding, software, AI prompts, algorithms, and documentation — is owned by Profica and protected by intellectual property laws. You may not copy, reverse-engineer, or redistribute any part of the Service.

License to us: By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service. We will not use your content for marketing or share it with third parties, except as described in our Privacy Policy.

6. Prohibited Use

You agree not to use the Service to:

• Generate content containing fabricated credentials, degrees, certifications, or work experience you do not possess.
• Create misleading, fraudulent, or deceptive application materials intended to misrepresent your qualifications.
• Operate multiple accounts or share account access with others.
• Circumvent or attempt to circumvent rate limits, credit systems, or other technical restrictions.
• Access the Service via automated means (bots, scrapers, or scripts) without prior written authorization.
• Use the Service in violation of any applicable law or regulation.

Violation of these terms may result in immediate account suspension or termination without refund.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance. If a generation fails due to a Service outage, your credits will not be consumed.

8. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Profica shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, loss of data, loss of employment opportunities, or any damages arising from your reliance on AI-generated content.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

By you: You may delete your account at any time through account settings. Upon deletion, your data will be handled in accordance with our Privacy Policy (soft-deleted immediately, permanently purged after 30 days). Unused purchased credits are forfeited upon account deletion.

By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited use, or if required by law. We will provide reasonable notice where possible. In cases of severe violation (fraud, abuse), termination may be immediate without notice.

Sections that by their nature should survive termination (e.g. Intellectual Property, Limitation of Liability, Governing Law) shall remain in effect.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence, including rights under the GDPR or other applicable consumer protection laws.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users or by prominent notice within the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
